This article connects the insights of post-realist scholarship about radical indeterminacy and its consequences for the legitimacy of adjudication to the current legitimacy crisis of the international investment regime. In the past few years, numerous studies have exposed serious shortcomings in investment law and arbitration including procedural problems and the substantive asymmetry of the rights protected. These criticisms have prompted a broad consensus in favor of amending the international investment regime and multiple reform proposals have appeared that appeal to the (...) rule of law ideal as an instrument for increasing the acceptability of the international investment system. This article argues that the reliance of such proposals on jurisprudential approaches that fail to adequately accommodate the post-realist indeterminacy critique and take seriously the role of ideology in adjudication renders reform efforts unable to solve the legitimacy problems of the investment regime. The conclusions suggest the need to abandon implausible claims to depoliticization and face the methodological challenges posed by the promise of ideologically balanced assessments advanced by some rule of law theorists. The article finally points at the urgency to reform traditional approaches to doctrinal work in order to increase awareness of critical challenges and open up doctrinal methods to alternative methodological avenues. We investigate whether age profiles of ethnobiological knowledge development are consistent with predictions derived from life history theory about the timing of productivity and reproduction. Life history models predict complementary knowledge profiles developing across the lifespan for women and men as they experience changes in embodied capital and the needs of dependent offspring. We evaluate these predictions using an ethnobiological knowledge assessment tool developed for an off-grid pastoralist population known as Choyeros, from Baja California Sur, Mexico. Our results indicate that (...) while individuals acquire knowledge of most dangerous items and edible resources by early adulthood, knowledge of plants and animals relevant to the age and sex divided labor domains and ecologies (e.g., women’s house gardens, men’s herding activities in the wilderness) continues to develop into middle adulthood but to different degrees and at different rates for men and women. As the demands of offspring on parents accumulate with age, reproductive-aged adults continue to develop their knowledge to meet their children’s needs. After controlling for vision, our analysis indicates that many post-reproductive adults show the greatest ethnobiological knowledge. These findings extend our understanding of the evolved human life history by illustrating how changes in embodied capital and the needs of dependent offspring predict the development of men’s and women’s ethnobiological knowledge across the lifespan. The main thesis defended in this paper is that Hildebrand’s distinction between what we could call quiddities—or “quasi-essences,” endowed with chaotic and accidental unity—and genuine essences possessing an intrinsically necessary unity, grounds the radical distinction between analytic and synthetic a priori knowledge. This thesis has not been expressly emphasized by Hildebrand himself. This study aimed to investigate the student-athletes' capability to face the academic, sport, and social challenges during the coronavirus disease 2019 (COVID-19) lockdown and to disclose novel aspects of dual careers. A 32-item online survey encompassing demographic characteristics, sport and university engagement, support and dual-career benefits, physical activity, sitting time, and the time deemed necessary to recover the previous level of performance was developed. Four hundred sixty-seven student-athletes (males: 57%, females: 43%) from 11 countries, competing in 49 different sports (individual: (...) 63.4%, team: 36.6%) at regional (17.5%), national (43.3%), and international (39.2%) levels, and enrolled at high school (21.9%) and university (78.1%) levels completed the survey. During the lockdown, the respondents decreased the time dedicated to sport and academics, although they maintained an active lifestyle. Student-athletes from countries under severe contagion were more likely to train at home, dedicate to academics, and receive support from the coach but less likely receive support from their teachers. With respect to their team sport counterparts, athletes competing in individual sports trained more and were more likely to receive support from their coaches. International athletes showed the highest training time and support from their coaches and as student-athletes. High school students received more support from their coaches and teachers, whereas university students were more likely considering dual careers useful to cope with the COVID-19 pandemic. This study substantiates the relevant role of competitive sports participation in the maintenance of active lifestyles, with student-athletes considering home training and e-learning valuable resources during the lockdown. It is not just another “philosophical divertimento” devoid of scientific and practical importance. Let us analyze the article in an orderly way.Less DsmThe authors of the target paper disapprove of the Diagnostic and Statistical Manual of Mental Disorders (DSM)-III/IV approach to defining illnesses by starting from the symptoms that are present—on the grounds that this may lead clinicians to assume that their sole role is to identify, fight, and suppress the symptoms by whichever procedure. They propose an alternative that is dear to myself because it follows the path of the so-called “anthropological” psychiatry of Binswanger, von Gebsattel, Erwin Strauss, Zutt, López-Ibor, Sr., and others. In essence, this is a phenomenological approach to the meaning of mental diseases, one that emphasizes how the illness is revealed to the patient him- or herself.The target article’s criticism of DSM should be considered in the context of the abuses committed on its behalf. The DSM is not a textbook of psychiatric disorders, nor does it contain a definition of the diseases. The DSM does not tell what a disease is (Klerman et al. 1984)—something that is impossible with a classification system based on the manifestations of the diseases, the signs and symptoms. The DSM, as its title states, is just a diagnostic and statistical manual, which does not contain anything about the origin of [End Page 259] any disease nor an explanation of why it exists or what it means. The DSM is, in fact, just a tool to determine whether a disease is present, and therefore to facilitate communication between professionals and with other individuals, without saying anything about the disease’s aitia—a key term (associated with notions of essence as well as cause) to be discussed below. In theory, most clinicians should understand these limitations; it may be, however, that this is not really the case for many who read or use the DSM. In the world there are around 200,000 psychiatrists; since 1980 the number of DSM copies sold is in the order of several hundred thousand.The misuse of a classification system is even more noticeable in the International Classification of Diseases (ICD)-10 Research Version. The instructions for the use of this version recommend that the first step is to make an inventory of all the symptoms present, and then to construct a diagnosis based on them. This how all computer-assisted systems work. This procedure can, however, only be valid if the clinician has already reached a diagnostic conclusion by other means—a diagnosis then to be confirmed for research purposes. It may be that this is one of the reasons why the ICD-10 Research Version has almost never actually been used for research.Furthermore, the concept of symptoms in psychiatry applies only to organic mental disorders (Schneider 1959), conditions in which the patient’s attitude and way of experiencing the symptoms do not play the kind of role that they play in schizophrenia and other mental disorders. Atrial fibrillation is the most common cardiac arrhythmia in clinical practice. It often starts with asymptomatic and short episodes, which are difficult to detect without the assistance of automatic monitoring tools. The vast majority of methods proposed for this purpose are based on quantifying the irregular ventricular response during the arrhythmia. However, although AF totally alters the atrial activity reflected on the electrocardiogram, replacing stable P-waves by chaotic and time-variant fibrillatory waves, this information has still not been explored for automated (...) screening of AF. Hence, a pioneering AF detector based on quantifying the variability over time of the AA morphological pattern is here proposed. Results from two public reference databases have proven that the proposed method outperforms current state-of-the-art algorithms, reporting accuracy higher than 90%. A less false positive rate in the presence of other arrhythmias different from AF was also noticed. Finally, the combination of this algorithm with the classical analysis of RR series variability also yielded a promising trade-off between AF accuracy and detection delay. Indeed, this combination provided similar accuracy than RR-based methods, but with a significantly shorter delay of 10 beats. (shrink)

The objective of this research is to develop accurate forecasting models for chlorophyll-α concentrations at various depths in El Mar Menor, Spain. Chlorophyll-α plays a crucial role in assessing eutrophication in this vulnerable ecosystem. To achieve this objective, various deep learning forecasting techniques, including long short-term memory, bidirectional long short-term memory and gated recurrent uni networks, were utilized. The models were designed to forecast the chlorophyll-α levels with a 2-week prediction horizon. To enhance the models’ accuracy, a sliding window method (...) combined with a blocked cross-validation procedure for time series was also applied to these techniques. Two input strategies were also tested in this approach: using only chlorophyll-α time series and incorporating exogenous variables. The proposed approach significantly improved the accuracy of the predictive models, no matter the forecasting technique employed. Results were remarkable, with |$\overline{\sigma}$| values reaching approximately 0.90 for the 0.5-m depth level and 0.80 for deeper levels. The proposed forecasting models and methodologies have great potential for predicting eutrophication episodes and acting as decision-making tools for environmental agencies. Accurate prediction of eutrophication episodes through these models could allow for proactive measures to be implemented, resulting in improved environmental management and the preservation of the ecosystem. Automatic public malware analysis services provide controlled, isolated and virtual environments to analyse malicious software samples. Unfortunately, malware is currently incorporating techniques to recognize execution onto a virtual or sandbox environment; when an analysis environment is detected, malware behaves as a benign application or even shows no activity. In this work, we present an empirical study and characterization of automatic PMAS, considering 26 different services. We also show a set of features that allow to easily fingerprint these services as analysis (...) environments; the lower the unlikeability of these features, the easier for us to fingerprint the analysis service they belong to. Finally, we propose a method for these analysis services to counter or at least mitigate our proposal. (shrink)

Many years before Adam Smith, numerous theologians associated with the School of Salamanca, such as Domingo de Soto, Juan de Lugo, Juan de Mariana, Luís Saravia de la Calle, Martin de Azpilcueta, Luis de Molina, Leonard Lessius, Thomas Cajetan, and Francisco Garcia had made great strides in the development of economics. Specifically, these theologians, otherwise known as the “Scholastics,” analyzed and argued against price and wage controls by explaining that the only “just” prices and wages are those (...) that are set by the market, examined and pushed back against prohibitions on usury, understood the concept of time preference, and helped develop monetary theory in multiple ways. They also demonstrated that all of this was consistent with the Catholic religion. This paper analyzes the ways in which these early theologians contributed to the development of economics and reconciled it with their Catholicism. (shrink)

This paper intends to analyse several different aspects of the recent evolution of Western Universities. This evolution is analysed through the examples offered by recent changes in the norms of some of these institutions, and the different elements that condition these changes are analysed as well. These changes could, to a certain extent, make it possible to speak about a refounding of universities, at least in Spain. The tools that are applied to the evaluation of universities are also taken into (...) account, as are the relative value of universities and the hierarchical dependence among them. Lastly, and with the aid of a practical example, the methods by which universities are evaluated are questioned. (shrink)

Ecological sciences have informed environmental ethics from its inception as a scholarly pursuit in the 1970s-so much so that we now have ecological ethics, Deep Ecology, and ecofeminism. Throughout the 20th century, however, most ecologists remained enthralled by the myth that science is value-free. Closer study of science by philosophers reveals that metaphors are inescapable and cognitively indispensable to science, but that metaphors are value-laden. As we confront the enormous challenges of the 21st century-the prospect of a 6th mass extinction, (...) acidifying oceans, rising sea level, and global warming-ecologists can no longer remain aloof from public discourse about what actions to take to address these problems. And that means that 21st century ecologists understand that right action is guided by ethics. However, integration of ethical ideas into academic curricula and ecologists' research agendas is still meager. Aldo Leopold, 1947 President of the Ecological Society of America, keenly understood that latent in ecological sciences is an organizing worldview, with implications for reordering societal values and expanding ethics to embrace "soils, waters, plants, and animals, or collectively: the land." Going beyond Leopold's land ethic, contemporary environmental ethics includes eco-social justice and the realization that as important as biodiversity is cultural diversity, inter-cultural, inter-institutional, and international collaboration requiring a novel approach known as biocultural conservation. Right action in confronting the challenges of the 21st century requires science and ethics to be seamlessly integrated. Contemporary science proposes the concept of the inclusive ecosystem that recognizes humans as components. In this book, this "inclusive conviction is endorsed, fortunately, by over forty contributors sharing their accounts, of living well in place, combining nature and culture, residing on landscapes: biocultural ethics" (Holmes Rolston, III). La sociedad del conocimiento y la introducción en los procesos de enseñanza-aprendizaje de las tecnologías de la información y la comunicación, están exigiendo de quienes nos dedicamos a la educación en el ámbito universitario, la utilización de nuevas estrategias didácticas y la reinvención de algunas antiguas o no tan nuevas. Se trata de dar respuesta a la demanda social de “aprender de otra manera” para mejorar la inserción de los nuevos egresados en su ámbito profesional. Esta nueva forma de aprender (...) debe tener en consideración las exigencias de los nuevos contextos de enseñanza-aprendizaje, donde el protagonismo de los estudiantes es un elemento esencial y la relación de lo aprendido con sus posibilidades de aplicación en el contexto profesional es el otro. Casualmente el modelo de formación basado en competencias desde el enfoque socioformativo coincide en ambos protagonismos y el portafolio como estrategia didáctica que puede utilizarse en este modelo puede ayudar a dotar de protagonismo al que aprende haciéndole tomar conciencia de que el aprendizaje no se produce de manera automática sino a través de una serie de pasos y etapas que a la vez que se van consiguiendo nos permiten reflexionar el proceso. Una vez llevado a cabo este proceso de reflexión general, puede aplicarse en el ámbito médico para iniciar al estudiante a tomar conciencia de su semejanza con el diagnóstico clínico. Se analiza críticamente la idea de Pueblo y el manejo de la Historia que suelen ser propios de las doctrinas nacionalistas, con sus correspondientes secuelas para la relación entre derechos individuales y derechos colectivos, y con sus consecuencias para el modo de concebir y de realizarse la democracia. También se ponen de relieve los problemas teóricos que encierran la noción de “derechos históricos”.

We used a qualitative dissociation procedure to assess semantic priming from spatially attended and unattended masked words. Participants categorized target words that were preceded by parafoveal prime words belonging to either the same or the opposite category as the target. Using this paradigm, only non-strategic use of the prime would result in facilitation of the target responses in related trials. Primes were immediately masked or masked with a delay, while spatial attention was allocated to the primes’ location or away from (...) the primes’ location. Immediate masked, strongly related primes facilitated target responses irrespective of the spatial attention. Delayed masked, related primes led to reversed or facilitatory priming depending on whether they were cued or uncued. These findings demonstrate that perceiving a stimulus with or without awareness depends on both stimulus quality and attention orienting and that non-strategic priming can be observed from clear visible but spatially unattended words.
